Section 10
Parties may merge or merge
(1) Two or more parties registered according to Section 4 may merge or merge by mutual agreement.
(2) Within forty-five days of such agreement for consolidation or merger in accordance with sub-section (1), the party to be consolidated or to be merged shall submit an application to the Commission by attaching a copy of its statutes, the decision of the Central Committee and the agreement as per sub-section (1).
(3) In the application according to sub-section (2), it should also be disclosed that any of such parties will be merged under the name of a party or will be merged under a new name.
(4) The Commission shall carry out necessary investigation on the application made under sub-section (2) and upon such investigation, if it is found that the procedures and conditions to be fulfilled according to this Act and the rules made under this Act regarding the merger or amalgamation of the parties, such party shall be merged within forty-five days of the registration of the application. He will decide to do or merge and give the certificate.
(5) In the event of consolidation or merger of parties in accordance with this Act, the name, flag, symbol, property or liability of such party shall be as mentioned in the agreement under sub-section (1).
(6) According to sub-section (5) at the time of amalgamation or merger of the parties, if the management of the assets or liabilities of the parties is not mentioned, such assets or liabilities shall be owned by the amalgamated or amalgamated party.
(7) In the case of party amalgamation or amalgamation in accordance with this section, no one shall be able to use the name, flag or symbol used by such party before amalgamation or amalgamation for one year from the date of amalgamation or amalgamation. But,
